IMPORTANT NOTICE: Please pay only Steve Mahfouz for the sale. Make sure you pay the correct profile. Only Steve Mahfouz or an Ecstasy Realty Estate Manager can assist you in land matters.

You are strongly encouraged, but not required, to join the group "Ecstasy Realty". This group will help keep you fully informed of all Ecstasy Realty information. Welcome to one of my private island sims ! I'm very glad that you decided to buy from me. I prepared these covenants to make your buying experience as pleasant as possible. You are bound by the Sales Covenants as soon as you pay the sales price. Please read them very thoroughly.

This Land Covenants applies to all sims that allow land sales, and includes all of the Special Provisions included. YOU MUST SCROLL DOWN ALL THE WAY TO READ ALL OF THE SPECIAL PROVISIONS FOR ALL OF THE ECSTASY REALTY SIMS.

1.0- Limitation of Liability: You, as the buyer, are buying a parcel or parcels of private island land from the CEO of Ecstasy Realty, Steve Mahfouz. Please understand that because of Linden Lab (LL) policies, you do not own any server space. In reality, you are leasing server space that you must pay tier payments every month in order to keep. Please also understand that if you are more than 7 (seven) calendar days late with a tier payment, your land will be reclaimed by Ecstasy Realty permanently. Therefore, it is incumbent upon you, as the buyer, to maintain tier payments to Steve Mahfouz on a timely basis. Ecstasy Realty and Steve Mahfouz do not bear any legal responsibility for business failure, scripts loss or damage, texture loss or damage, or prims loss or damage if your land must be reclaimed due to failure to pay tier on a timely basis.

If tier is paid to the incorrect in-world profile or to the incorrect Paypal email address, it shall be regarded as not having been paid. Please double check all payment procedures to make sure your tier payment reaches Steve Mahfouz and no one else.

1.1- Applicability of Standard Sales Covenant: The Standard Sales Covenant present on this sim is applicable to the initial parcel purchaser, as well as each suceeding owner of the parcel or parcels upon this sim. The Sales Covenant applies immediately upon purchase of the parcel from Ecstasy Realty or from another parcel owner. Each owner of the parcel is responsible for knowing and complying with its contents. Each owner of the parcel is responsible for paying tier on a timely basis.

2.0- Date of Tier Payments: Your tier payment is due on the first (1st) day of every month or 12 (twelve) times per year. Even if you buy your land on the last day of the month, you must still pay the tier for the next month. There is no negotiation on this policy, so please do not ask.

3.0- WHO MUST PAY TIER: The person who owns the parcel on the first (1st) day of the month at 12:01 AM Pacific Standard Time (PST) or Pacific Daylight Time (PDT) must pay the tier payment, even if the land is to be sold later in the day. If it is not obvious from the About Land window who owns the parcel, the President or CEO or Founder of the land group will be billed. Please act accordingly. Ecstasy Realty and Steve Mahfouz bear NO legal liability if your land is reclaimed due to confusion and/or inability to ascertain the correct owner of the land.

4.0- Consequences of Failure to Pay Tier in a timely manner: If your tier payment for your parcel is more than 7 (seven) calendar days late, your land will be reclaimed without notice to you and all of your prims, scripts and textures will be returned to you. You will be able to find your prims, scripts and textures in your Lost and Found folder in one or several combined files with a cluster icon next to it.

5.0- The definition of a land sale: You as the buyer are buying a long-term lease on a parcel of virtual real estate. You understand that your initial payment is simply a large lump sum payment to the Owner (Steve Mahfouz) to reimburse him for the purchase of the sim. The large lump sum payment is also a down payment on the long term lease.

6.0- "Long term" shall be defined as the mutual desire of both Steve Mahfouz and the buyer to maintain the lease for a period of longer than one month. Several unforeseen events can interfere with this desire. They include, but are not limited to, death, serious injury, and/or hospitalization of Steve Mahfouz; closure or sale of LL; policy changes by LL which could change the feasibility of continuing the lease; failure by buyer to make timely tier payments; sale of the sim; and violations of LL's TOS and/or Community Standards. Despite the "long term lease" language, buyer acknowledges this is basically a month to month sublease of LL server space, due to the uncertainties of life in general and SL in particular.

6.1- Definition of "parcel owner": The parcel owner is the person who is currently paying tier charges to Steve Mahfouz for the usage of the parcel. It is explicitly understood that Steve Mahfouz is the actual real owner of the parcel per Linden Lab policy.

7.0- Warranty as to the sale of this sim to another owner: Steve Mahfouz will make every reasonable effort to sell the sim to a purchaser who guarantees your property rights. However, once the sale of the sim is completed, Steve Mahfouz no longer has any legal liability whatsoever. If market and/or personal financial conditions are sufficiently poor, Steve Mahfouz reserves the right to sell the sim to a willing buyer.

8.0- Stipulation as to the true legal owner of your sim and parcel: At the writing of this Standard Sales Covenant, Steve Mahfouz is and will continue to be the true legal owner of your parcel. Linden Lab policy dictates this stipulation.

9.0- Declaration of Non-interference: The usage of your parcel is governed by Linden Lab Terms of Service (TOS) (http://secondlife.com/corporate/tos.php ) and Community Standards ( http://secondlife.com/corporate/cs.php ).
Ecstasy Realty and its CEO will not interfere with your usage of the parcel unless you fail to make a timely tier payment or fail to abide by all Sales Covenants provisions. However, if LL notifies Steve Mahfouz of violations of TOS or Community Standards on your parcel and if these violations are not cured, Steve Mahfouz reserves the right to take any steps necessary to preserve his investment including, but not limited to, terminating the lease and banning all occupants.

10.0- Tier payment reminder policy: One (1) notecard reminder will be sent to you before the expiration of the 7 (seven) calendar day grace period. If you do not receive the notecard for any reason, Ecstasy Realty and its CEO Steve Mahfouz are free of any legal liability. You as the purchaser are ultimately responsible for timely tier payments.

11.0- Parcel resell policy: You as the purchaser have complete and total freedom to sell your parcel as you see fit. However, whoever owns the parcel per the About Land window on the first (1st) day of the month at 12:01 AM PST or PDT must pay the tier payment for the entire month. Please govern yourself accordingly.

12.0- List of sims that allow parcel resell: Ecstasy City

12.1- Special Provisions for Ecstasy City: Ecstasy City is intended to be a downtown urban sim. You may develop the land as commercial or very high density residential, such as high rise apartment buildings or high rise condominium buildings. You agree to keep your parcel free of trash and debris and to abstain from using any prims or textures that are commonly labelled as "eyesores". You agree to keeping all sound and chat within the boundaries of your parcel. You agree to keep all floating skyboxes or sandboxes or clubs above 500 meters. Infrastructure cannot be modified or moved. Shopping malls must have an opaque roof. Rotating signs are forbidden. Residents are encouraged to tie their build in with the infrastructure. No science fiction or fantasy builds are allowed. You are allowed to flatten your land to build but you cannot raise or elevate your land at all. You are not allowed to lower your land below the other parcels. You cannot build any hills on your parcel.

Vehicles that are in good repair may be parked on the streets. All builds must appear to be from the time period 2007 to 2027 and to be as close to real life as possible. All structures must be at least 4 stories (30 meters) in height on this sim. All signs on parcels and buildings must be in good taste and not appear as graffiti. Ecstasy Realty reserves the right to pass final judgment on any structure or building. Suge Winnfield as Ecstasy Realty Developer is the agent for Ecstasy Realty in building inspection matters. If your buildings do not meet the high quality standards of Ecstasy City, you will be required to rebuild it or allow Suge Winnfield to build it for you. All structures or buildings on this sim must blend in with a downtown urban theme. All buildings must appear to be in excellent condition and have no broken windows or boarded-up windows. Anything appearing to be "ghetto" or from a poverty-stricken area will be removed immediately. Escort businesses and "strip clubs" must have tasteful signs that do not blink or rotate. Signs cannot be readable from more than 20 meters away. Residents who cannot build or who are not confident of their building skills are strongly encouraged to contact Suge Winnfield for assistance.

13.0- Day-to-Day Responsibility for the Parcel: You as the buyer are 100% responsible for the day to day care and operation of your parcel. However, LL forces you to request reboots/restarts from Steve Mahfouz or from a Ecstasy Realty Estate Manager found on this official list: http://ecstasyrealty.com/current-list-of/

Rollbacks will only be granted if everyone on the sim agrees to it in writing on a notecard. Steve Mahfouz will verify everyone's agreement to the rollback. ONLY STEVE MAHFOUZ WILL REQUEST A ROLLBACK DUE TO THE SERIOUS NATURE OF THIS OPERATION.

14.0- Official Parcel Price List:

2000 square meters (914 prims) = $135 USD or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

2048 square meters (937 prims) = $138 USD (United States Dollars) or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

4096 square meters (1875 prims) = $276 USD or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

8192 square meters (3750 prims) = $552 USD or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

16,384 square meters (7500 prims) = $1104 USD or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

32,768 square meters (15,000 prims) = $1920 USD or the equivalent in Lindens or Euros, payable only to Steve Mahfouz

All parcels will be double prims, so no parcels are possible larger than 32,768 square meters.

14.05- Who the Sale Price is Paid to: The initial parcel sales price is always paid to Steve Mahfouz and to no one else under any circumstances.

15.0- Official Tier Payment List:
2000 square meters = $29.74 USD per month or its equivalent in Lindens or Euros
2048 square meters= $30.45 USD per month or its equivalent in Lindens or Euros.
4096 square meters = $60.90 USD per month or its equivalent in Lindens or Euros.
8192 square meters = $121.80 USD per month or its equivalent in Lindens or Euros.
16,384 square meters = $243.60 USD per month or its equivalent in Lindens or Euros.
32,768 square meters = $487.20 USD per month or its equivalent in Lindens or Euros.

Be advised that tier payments are subject to change if and when LL alters their land use fee schedule. If and when LL alters their land use fee schedule, each parcel owner shall be notified by notecard of the increase in tier fees, effectively immediately. Parcel owners may also stay abreast of the latest applicable tier fee by reviewing the Standard Sales Covenant at http://ecstasyrealty.com

15.1- How Tier is Paid: Tier is always paid directly to the profile of Steve Mahfouz in-world. If you pay with USD or Euros, you will pay the Paypal email address of Steve Mahfouz.

16.0- Purchase or Tier Payment Methods Available:
You may pay for your purchase with Lindens, United States Dollars (USD) or Euros. If you pay with USD or Euros, please IM Steve Mahfouz or send him a notecard via his profile to ask him for his Paypal address (https://www.paypal.com )

17.0- Liability of Linden Lab: Linden Lab is only responsible for the adequate functioning of the grid and of this sim. Linden Lab will not intervene in transactions between residents, unless a clear violation of the TOS is alleged.

18.0- Venue for litigation: You as the buyer are explicitly agreeing to this clause when you purchase this land parcel. The venue for all court litigation involving this parcel is Sanford, Florida, in Seminole County, Florida.

19.0- No Refunds Policy: You as the buyer are explicitly agreeing to this clause when you purchase this land parcel. Once you have made a purchase of land or made a tier payment, you are not entitled to a refund under any circumstances. Please govern yourself accordingly. Likewise, if the sim is sold to another owner or is reclaimed by Linden Lab, you are not entitled to any refunds.

20.0- Totality of Agreement between Buyer and Seller: This Standard Sales Covenant forms the totality of the Agreement between Buyer and Seller. No verbal messages, instant messages, notecards or electronic mail may be introduced into court evidence to modify this Agreement.
